TERMS AND CONDITIONS
Rent Como Lake (lessor) rents to the customer (customer) the vehicle indicated on the front of this rental letter (vehicle) under the terms and conditions set out below:
Art. 1 - The minimum age for renting scooters and mopeds is 18 years. For those under 18 years of age, parental consent is required, with the parent assuming responsibility.
Art. 2 - The rental begins on the day and time of delivery of the vehicle to the Customer indicated on the front of this rental letter and ends on the day and time of return of the vehicle to Rent Como Lake.
The vehicle is delivered in perfect condition except for what is stated on the front of this letter; the Customer undertakes to return it in the same condition in which it was delivered, except for normal wear and tear due to rental use, on the day and at the time indicated in this rental letter. Should the customer wish to change the terms of return (date, place, time), they must obtain prior consent from Rent Como Lake by making a request at least 24 hours before the scheduled return date.
Art. 3 - The vehicle must be driven exclusively by the Customer, or by a person indicated at the time of the contract, except in the cases provided for by art. 1; at the time of signing, the Customer must prove that they hold a valid driving license authorizing them to drive the vehicle, which may not be transferred to other persons. The Customer expressly declares to be responsible for the actions and omissions of anyone driving the vehicle, except where this is due to unlawful acts that cannot be prevented by the Customer.
Art. 4 - The vehicle may not be driven by persons who are intoxicated or unconscious, or under the influence of alcohol or drugs, or who are in psychophysical conditions contrary to the rules of the highway code; it may not be used for illegal purposes, for speed races, for the transport of passengers for a fee, and it may not leave Italian territory.
Art. 5 - The Customer and any other person authorized to drive are covered by third-party liability insurance up to a maximum of €6,000,000.00, with a deductible of €250.00 payable by the customer.
Art. 6 - The Customer will in any case be responsible for damages caused by the vehicle due to improper use, as well as for theft, failure to return the keys, or any other use in violation of laws and regulations:
The Customer is not covered by insurance:
a) for damages incurred by Rent Como Lake for the immobilization of the vehicle to carry out repairs due to the Customer's fault;
b) for the costs incurred by Rent Como Lake for the transport of the vehicle by tow truck unless insurance coverage is activated and/or for the repair of the same;
c) for damages affecting the driver, objects, and luggage transported in the vehicle;
d) for damages caused in any way to the frame, wheels, paintwork, mirrors, top case.
Art. 7 - In the event of an accident, the customer is required to notify Rent Como Lake of the incident by phone and in writing within 12 hours of the accident, by filling out the CID form and having the necessary checks carried out by the competent authorities.
Art. 8 - In case of breakdown or accident, it is strictly forbidden to allow personnel not authorized by Rent Como Lake to intervene.
Art. 9 - The rental payment must be made in advance, credit cards are accepted. In case of a change in duration, the current rate for the extension will apply.
Art. 10 - The vehicle is delivered with a full tank of fuel. If the vehicle is not returned with a full tank, the Customer will be charged €20.00 for the service plus the cost of the fuel.
Art. 11 - All vehicles must be returned on the scheduled day and at the scheduled time indicated on the front of this letter, otherwise an additional day of rental will be charged.
Art. 12 - In case of loss of the vehicle keys, the customer must reimburse an amount of €150.00 in addition to the costs provided for any recovery, while in the event that documents or the license plate are lost, the amount to be reimbursed is €250.00.
Art. 13 - The security deposit of €400.00 is mandatory. If, upon return of the vehicle, any damage to the vehicle is found, this deposit will be withheld by Rent Como Lake as compensation for the damages incurred, without prejudice to the right to claim further damages. Liability for damages is entirely the responsibility of the customer.
Art. 14 - The deposit must be guaranteed with a credit card.
Art. 15 - For any dispute arising from and/or connected with the rental of the vehicle, the court of Como shall have exclusive jurisdiction.
Art. 16 - In case of any discrepancy in the interpretation of the two versions of this letter, the Italian version shall prevail over those in other languages.
Art. 17 - Personal data will be used solely and exclusively for purposes related to the contract and may be provided to third parties only for purposes connected to the contract itself (L.196/2003).
